Terms of Use

Welcome to The Art Room Center for Creative Healing, LLC (“The Art Room,” “we,” “us,” or “our”).

These Terms explain the conditions for using our website and its publicly available resources. Please review them before using the website. By accessing or using the website, you agree to follow these Terms to the extent permitted by applicable law.

These are website terms—not consent to therapy or an agreement to participate in a program. Any additional consent or agreement required for a particular service will be requested separately.

1. Website terms and service agreements

Clinical services are subject to the informed consent, financial agreement, telehealth consent, and other documents applicable to your care. Art Clubs, workshops, and other programs are subject to their specific registration and participation agreements.

For matters relating to a particular service—including fees, payment, cancellations, refunds, attendance, and participation—the agreement provided for that service applies, subject to applicable law.

These Terms do not replace those agreements, authorize treatment or payment charges, or change an existing client’s financial or treatment arrangements. They also do not reduce your privacy rights or our professional responsibilities.

2. Educational information and the therapy relationship

Our website’s articles, videos, downloadable resources, and other educational content provide general information. They are not individualized mental health advice, diagnosis, or treatment and should not replace consultation with an appropriately qualified professional.

Reading our content, following our professional social media accounts, submitting an inquiry, or scheduling an introductory consultation does not, by itself, establish an ongoing therapist-client relationship. Clinical services begin through an agreed intake and treatment process with the assigned clinician. The Art Room

3. Services, programs, and registration

A general inquiry does not, by itself, confirm an appointment, guarantee availability, or reserve a place in a program. Confirmation is handled through the applicable scheduling or registration process.

Service-specific fees, payment arrangements, cancellation rules, refund conditions, and participation requirements will be provided through the relevant financial or registration agreement. These website Terms do not establish a separate cancellation or refund policy.

Art Clubs, creative classes, and wellness workshops identified as nonclinical offerings are not psychotherapy or clinical art therapy treatment. Participation in those offerings does not establish a therapist-client relationship. An activity’s being led by a licensed therapist does not, by itself, make it clinical treatment.

Programs expressly identified as therapy services follow a separate clinical consent and treatment process.

4. Privacy and information you submit

Our Website Privacy Policy explains how we handle information collected through the website and related online tools. Our separate Notice of Privacy Practices addresses protected health information associated with clinical services. You may contact us for a copy of that notice.

Information submitted while seeking or arranging care may receive health-information protections even before an ongoing therapist-client relationship is established. Website use does not waive those protections or replace an authorization required by law. HHS.gov

Please use general inquiry forms for scheduling and administrative questions. Do not include detailed treatment history, diagnoses, insurance identification numbers, payment-card details, or other sensitive information unless you are using a designated process intended for that purpose.

Provide accurate information and submit information about another person only when you are authorized to do so. These precautions do not reduce our obligations regarding information we receive.

5. Not for emergencies

The Art Room does not provide 24-hour crisis services. Website forms, email, voicemail, and social media messages are not continuously monitored and should not be used to request emergency assistance. 

In the United States, call or text 988 for suicide or mental health crisis support. For immediate physical danger or a medical emergency, call 911 or go to the nearest emergency department. Do not wait for a response from our practice.

6. Responsible website use

Use the website lawfully and in a way that respects other people’s privacy, rights, and access.

Do not attempt to access another person’s account or private information, bypass security measures, introduce malicious software, impersonate another person, submit spam or threats, or disrupt the website’s operation.

We may restrict website access when reasonably necessary to address misuse or protect security. A website-access restriction does not, by itself, terminate an existing therapeutic relationship or eliminate your right to request records or communicate with the practice through an appropriate alternative method.

Nothing in these Terms prohibits lawful criticism, reviews, complaints, or reports to a licensing board or other authority.

 

7. Content ownership and permitted use

Practice-created website content belongs to The Art Room unless otherwise indicated. Licensed images, guest contributions, client artwork, and other third-party materials remain subject to their respective owners’ rights. We do not claim ownership of material simply because it appears on our website.

You may view our public pages, share links to them, and download or print resources we expressly make available for personal, noncommercial use, provided you retain applicable attribution and copyright notices. Any additional terms displayed with a particular resource also apply.

This permission does not authorize resale, republication of entire articles or resources, use of our branding to suggest an affiliation, or presenting our materials as your own. Contact us to request permission for uses beyond those permitted here or by applicable law.

Nothing in these Terms is intended to restrict fair use or other uses permitted by copyright law. U.S. Copyright Office

Client artwork and personal information. Submitting information through the website or agreeing to these Terms does not grant us a general license to publish your artwork, photographs, treatment information, or personal story. Uses outside treatment require a separate discussion and any necessary permission or authorization; treatment consent does not itself authorize website, social media, or marketing use of clinical artwork.

8. Search engines and automated access

We permit ordinary search-engine indexing of publicly accessible pages, subject to our published crawler restrictions and reasonable access limits. Other automated access requires our permission unless permitted by applicable law.

Automated tools must not bypass access controls, access private forms or records without authorization, collect personal information unlawfully, or place an unreasonable load on the website.

Permission to crawl or index public pages does not grant unrestricted permission to copy, republish, sell, or otherwise reuse website content. Any use beyond indexing remains subject to applicable rights, permissions, and law.

9. Third-party websites and services

Our website may link to or incorporate outside resources and tools, including services used for scheduling, registration, payments, benefits assistance, or client-portal access.

Those providers may have their own terms and privacy notices. Please review the information applicable to a service before using it.

A link to an outside resource does not, by itself, mean that we endorse every statement, product, or service offered there. We do not control all aspects of third-party websites or their availability.

These provisions do not eliminate The Art Room’s responsibilities for its own conduct, its handling of information, or any legal obligations associated with the providers it uses.

10. Website availability and limits of liability

We work to keep the website useful and accurate, but we cannot guarantee that every page will always be complete, current, error-free, or continuously available. Maintenance, technical problems, and outside service interruptions may affect access.

Please contact us to confirm information that is important to a service or registration decision. Correcting website information does not, by itself, change a previously agreed fee or the terms of a confirmed purchase.

To the extent permitted by law, The Art Room and individuals acting on its behalf are not liable for indirect, incidental, special, consequential, or punitive damages arising solely from the use of, or inability to use, the public website and its nonclinical informational content.

This limitation does not apply to liability arising from clinical care or professional negligence, breaches of privacy or confidentiality, fraud, gross negligence, intentional misconduct, or any liability that cannot lawfully be limited.

Nothing in these Terms reduces the professional responsibilities applicable to services we actually provide, including services delivered through an online platform.

11. Changes to these Terms

We may update these Terms to reflect changes in the website, our services, or applicable requirements. The effective date above identifies the current version.

When additional notice or renewed agreement is required, we will provide that notice or request that agreement.

Posting revised website Terms does not retroactively change completed purchases or amend an existing clinical, financial, or registration agreement. Changes to those arrangements will be handled through the process applicable to that service.

12. Governing law and your rights

These website Terms are governed by Maryland law and applicable federal law. This provision does not remove any mandatory legal protections that apply to you.

If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Nothing in these Terms requires you to give up a right or remedy that cannot lawfully be waived, prevents you from raising a concern about our services, or requires you to contact us before making a complaint to an appropriate authority.
